David A. Lerman has been representing clients in labor and employment law cases in the Bay Area for almost 30 years. He has helped clients with claims for money damages for lost wages, unpaid overtime, emotional distress, lost benefits, and punitive damages as a result of alleged illegal employment practices.  

Legal claims have included wrongful termination of employment in violation of public policy, whistle-blowers, unpaid wages, unpaid overtime, missed meal breaks, retaliation for complaining about serious violations of public policy, intentional interference with contract, intentional interference with prospective economic advantage, intentional infliction of emotional distress, fraud, battery, disability discrimination, race discrimination, pregnancy discrimination, sexual harassment, and other employment related claims.  David A. Lerman also reviews proposed severance agreements and helps negotiate more favorable terms.

David A. Lerman represented the Plaintiff in the trial court in the case of LaGrone v. City of Oakland, et al. (2011) 202 Cal.App.4th 932.  The Court issued a writ of mandamus to compel the City of Oakland to rehire the Plaintiff and awarded him backpay for years of lost wages and benefits after he was illegally terminated.

David A. Lerman represented the Plaintiff in Monastiero v. Intervideo, Inc., (2006) A109590, where the jury awarded the Plaintiff over $1,100,000 plus interest for breach of a contract to award stock.

David A. Lerman represented the Plaintiff in an action against the Fred Finch Youth Center, where the jury found that the Plaintiff was fired in retaliation for making a mandatory report of child abuse to law enforcement and awarded over $200,000 of damages.

David A. Lerman worked with Attorney Stephen Danz to represent the Claimant in a fraud claim against IDS Life and IDS Financial Services which resulted in a binding arbitration award of $272,000 for the Claimant.

David A. Lerman worked with Attorney Stephen Danz to represent the Plaintiff in the case of Maxwell v. Beverly Enterprises, Inc., et al. (1998) previously published at 64 Cal. App. 4th 231. The Plaintiff was illegally fired for reporting alleged Medicare fraud and neglect of a nursing home patient that led to her death. The jury awarded over $1,600,000 in damages.

David A. Lerman has worked with employers to assure compliance with applicable laws and avoid protracted legal claims.

Accident and Injury Law.
David A. Lerman represents accident victims in cases involving auto accidents, bicycle accidents, pedestrian accidents, animal attacks, and defective products.  He helps clients through the recovery process and helps them protect their legal rights.

David A. Lerman obtained a settlement of $100,000 for bicyclist that was hit by a drunk driver.

David A. Lerman obtained a settlement of $80,000 for a woman  attacked by a dog.

David A. Lerman obtained a settlement of $50,000 for a bicyclist hit by a vehicle that ran a stop sign.

David A. Lerman has successfully litigated  Federal False Claims Act cases involving allegations of fraud against the United States of America.
